Terms & Conditions - The Borrowed Piece
Introduction
These Terms and Conditions ("Terms") govern your use of The Borrowed Piece puzzle rental subscription service, including our website, mobile applications, and physical puzzle rental service (collectively, the "Service"). The Service is operated by The Borrowed Piece Pty Ltd (ABN: 70 404 969 424) ("we", "us", or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
Australian Consumer Law
Nothing in these Terms limits, excludes, or modifies any rights you may have under the Australian Consumer Law (ACL), which forms part of the Competition and Consumer Act 2010 (Cth). Under the ACL, consumers have certain rights which cannot be excluded, including guarantees as to the acceptable quality and fitness for purpose of goods and services. Our goods and services come with guarantees that cannot be excluded under the ACL.
Membership and Subscription
- Eligibility
To subscribe to The Borrowed Piece, you must:
- Be at least 18 years of age.
- Reside in Australia.
- Provide valid payment information.
- Provide accurate contact and delivery information.
- Please note puzzles contain small pieces and should be kept away from small children.
- Subscription Plans
- Details of our subscription plans, including pricing, rental limits, and shipping terms, are available on our website.
- We reserve the right to modify our subscription plans with reasonable notice.
- All prices are in Australian dollars and include GST.
- Billing
- Subscription fees will be charged to your nominated payment method at the start of each billing cycle.
- By providing payment information, you authorize us to charge the applicable subscription fees.
- If we are unable to process your payment, we may suspend your account until payment is received.
- Cancellation and Refunds
- You may cancel your subscription at any time through your account settings.
- Cancellation will take effect at the end of your current billing period, and after puzzles have been successfully returned.
- If puzzles are not returned within the timeframe, you may be charged the next months rental fee
- We do not provide refunds for partial subscription periods.
- In accordance with the ACL, you may be entitled to a refund if we fail to provide the Service as described or if the Service is not fit for purpose.
Puzzle Rental Terms
- Rental Period
- The rental period begins when you receive a puzzle and ends when we receive the returned puzzle.
- Rental duration limits are specified in your subscription plan.
- Condition of Puzzles
- All puzzles are inspected before shipping to ensure they are complete and in good condition.
- You are responsible for returning puzzles in substantially the same condition, allowing for reasonable wear.
- Missing Pieces
- If you discover missing pieces upon receipt, please notify us.
- If pieces go missing while in your possession, you may be charged a replacement fee.
- Replacement fees will not exceed the retail value of the puzzle.
- Returns and Exchanges
- Return shipping materials and instructions will be provided with each puzzle.
- You are responsible for ensuring puzzles are properly packaged for return.
- New puzzles will be dispatched after we receive your returned puzzles.
- Excessive delays in returning puzzles may result in additional charges or suspension of service.
- Loss or Damage
- If a puzzle is lost or damaged beyond normal wear while in your possession, you may be charged a replacement fee.
- Replacement fees will not exceed the retail value of the puzzle plus applicable shipping costs.
- You will be notified before any replacement fees are charged to your account.
Privacy and Data
We collect and use your personal information in accordance with our Privacy Policy, which is available on our website and complies with the Privacy Act 1988 (Cth).
Intellectual Property
All puzzles remain the property of The Borrowed Piece or our suppliers. The design, graphics, and other intellectual property within the puzzles are owned by their respective copyright holders.
Limitation of Liability
To the extent permitted by law, including the ACL:
- We are not liable for any indirect, consequential, or incidental damages arising from your use of the Service.
- Our liability is limited to the amount you have paid for the Service in the 12 months preceding any claim.
- These limitations do not apply to any liability that cannot be excluded or limited under applicable law, including the ACL.
Modifications to Terms
We may modify these Terms at any time by posting the updated terms on our website. Your continued use of the Service after any changes indicates your acceptance of the modified Terms. Material changes will be notified to you via email.
Termination
We reserve the right to terminate or suspend your account for violation of these Terms or for any other reason, with reasonable notice where possible. Upon termination, you must return all puzzles in your possession.
Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales, Australia.
